Information We Collect
Personal Information
Account Information: When you create an account, we collect personal information such as your name, email address, and username. For students, a class code provided by your teacher is also collected.
Coursework and Grading: We collect information about your projects, responses, and grades to provide educational services and support your learning progress.
Technical Data
We automatically collect information about your device and usage patterns through cookies and other technologies. This includes IP addresses, browser type, operating system, and data about your interactions with our website.
Student Code and Projects
We store the code, programs, and other content created by students to facilitate continuous learning and project reviews by teachers.

We will retain Personal Information, including after the school term in which a teacher or student uses the Services, for only as long as is reasonably necessary to fulfill the purpose for which the information was collected. Generally, Qubits Learning will delete a user's Personal Information 4 years after the user's last login to the Services. Users may request deletion of their Personal Information at any time.
Changes to This Policy
We may update this Privacy Policy from time to time. Significant changes will be communicated via email or through prominent notices on our website. Before implementing any material changes to how we handle student PII, we will provide account holders (schools, parents, or students) with notice and choices regarding the new terms. Continued use of our services after such changes constitutes acceptance of the new terms.
Your Rights and Choices

Data Deletion: You may request the deletion of your personal data. We will take reasonable steps to delete your data unless we are required to retain it for legal or legitimate business purposes.

COPPA
Below is important information regarding the Children’s Online Privacy Protection Act (“COPPA”) and how it applies to our services. COPPA requires online service providers to obtain verifiable parental consent before knowingly collecting personally identifiable information (PII) from children under the age of 13.
At Qubits Learning LLC, we only collect Personal Information from children under 13 if their school, district, or teacher has agreed—through our Terms of Use—to obtain parental consent for the student to use our services and disclose Personal Information to us.
However, no child under 13 is permitted to submit Personal Information directly unless they are signed up through their school, district, or teacher, and the required parental consent has been obtained.
If you are a student under 13:
Do not send us any Personal Information unless your school, district, or teacher has obtained prior parental consent.
Do not share any Personal Information beyond what is specifically requested for the use of our services.
If we discover that we have collected Personal Information from a child under 13 without proper parental consent—or that a child has provided more information than necessary—we will delete the information as soon as possible.

For Schools, Districts, and Teachers
If you are signing up for this service and creating student accounts, you confirm that you are:
A teacher, school administrator, or authorized representative acting on behalf of students.
Responsible for COPPA compliance, including obtaining written parental consent before allowing children under 13 to access our services.
When obtaining parental consent, you must provide parents with:
A clear explanation of what data will be collected and how it will be used.
A way to review, modify, or delete their child’s information upon request.
Instructions on how to revoke consent if desired.
By using our services, schools, districts, and teachers accept full responsibility for ensuring compliance with COPPA regulations.

FERPA
We understand the importance of schools complying with the Family Educational Rights and Privacy Act ("FERPA") and its associated regulations. At Qubits Learning LLC, we rely on our school partners to help ensure that we fulfill our obligations under FERPA. While we cannot provide legal advice regarding compliance, we are committed to working with you and your legal counsel as needed to help both parties meet their responsibilities.
We handle all Personal Information, including data contained in Education Records or Directory Information, in strict accordance with our Privacy Policy.
Some of the information provided to us by School Personnel may qualify as an education record under FERPA ("Education Record"). Other data, such as a student’s name and grade level, may fall under Directory Information, which is not classified as an Education Record under FERPA. Schools cannot disclose personally identifiable information (PII) from a student’s education records to a third party without obtaining written parental or student consent or meeting one of the FERPA exemptions, such as:
The Directory Information Exemption, which allows the release of designated student information unless a parent or student opts out.
The School Official Exemption, which permits disclosure to school officials with a legitimate educational interest.
As School Personnel providing Directory Information or Education Records to Qubits Learning LLC, you confirm that your institution has complied with FERPA requirements by:
Complying with the Directory Information Exemption, including:
Notifying parents and eligible students of what information is considered directory information and may be disclosed.
Allowing parents and eligible students a reasonable period to opt out of such disclosures.
Complying with the School Official Exemption, including:
Informing parents in the annual FERPA notification that your institution defines "school officials" to include service providers, and that "legitimate educational interest" includes services provided by Qubits Learning LLC.
Obtaining written parental or eligible student consent when necessary to share Directory Information or Education Records with Qubits Learning LLC, solely for the purpose of delivering our services.
Additionally, it is critical that School Personnel do not share information about any student or parent who has opted out of Directory Information disclosure under FERPA.
Subcontractor Requirements
We may share information with third-party service providers who perform functions on our behalf, such as data hosting and analytics, under strict confidentiality agreements. These service providers are obligated to follow the same commitments regarding the collection, use, and protection of student PII as outlined in this Privacy Policy. They are prohibited from using student PII for any purposes other than those authorized by Qubits Learning and must adhere to our strict data protection standards.
Successor Entities
We may disclose information that we collect or you provide as described in this privacy policy to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, in which Personal Information that we hold is among the assets transferred. Any successor entity will be required to adhere to the same commitments for the previously collected Student PII or provide notice and obtain consent for any changes.
